West Babylon homeowners get zoning OK for second-floor addition with decking condition

The Town of Babylon Zoning Board of Appeals granted a variance to John Mahoney and Kristen Mahoney on application 26-48 to allow a second-floor addition to their West Babylon home, subject to a condition that rear-yard decks not be enclosed.

John Mahoney told the board he and his wife are expecting a second child and need more space. The board recorded planning and environmental-control memos and a survey by William Simmons dated Sept. 15, 2023, and plans by Spaces Architecture dated Jan. 12, 2026. Mahoney confirmed the rear deck’s dimensions are unchanged and that the above-ground pool installed in 2024 was an oversight and is being legalized.

A board member (Committee member) asked whether the rear deck would be further enclosed or covered; Mahoney responded, “No plans for that ever.” The member moved to delete variance number 3 (diminished rear setback) and later moved to approve application 26-48 with the explicit condition that the rear-yard decks not be enclosed; the chair seconded and the motion carried. The applicant thanked the board.

The approval is conditioned on compliance with the recorded plans and the requirement that the rear deck not be enclosed. The board indicated the decision will be mailed to the applicant in writing; no immediate building permit is authorized until the building department issues it.
