Law director outlines Board of Zoning Appeals powers, voting rules and recent ordinance changes

City law director Mr. Hastings summarized the responsibilities and limits of the Board of Zoning Appeals and reviewed recent ordinance changes affecting boards and commissions.

Hastings told the board it is a five-member body appointed by the city commission; three members constitute a quorum and three votes are required to grant a variance. He explained that area-variance decisions use a "practical-difficulties" test while use variances use an "unnecessary-hardship" test and advised members to frame decisions around statutory criteria rather than personal preference.

Hastings also described a recent ordinance that automatically removes members who miss three consecutive meetings and explained that appeals from the board of zoning appeals will now go to the city commission rather than the municipal court in order to align processes with the planning commission. He urged members to stick to the criteria in the ordinance when explaining votes to reduce legal risk.

Board members asked clarifying questions about how specific code sections apply; Hastings directed members to the handout and recommended discussing as many relevant criteria as possible when taking action. The board received the presentation as guidance for future decisions.
