Allentown zoning board records withdrawal and denies absent applicants in April 13 session

The Allentown Zoning Hearing Board on April 13 recorded the withdrawal of one appeal and denied another application after the appellant failed to appear.

Staff told the board that Case 2 (appeal by MPC Allentown LLC) had been withdrawn the prior week and would not be heard. Separately, Case 1 (appeal by North Fifth Street LLC for property at 827 North 5th Street) was called and the appellant did not appear. A board member moved to deny that application for lack of testimony and lacking evidence; the motion was seconded and the board voted in favor.

Committee member S5 explained the procedural basis for denial, saying the absence of testimony and evidentiary material prevented the board from making an informed decision. The board confirmed its next meeting is scheduled for April 27, 2026, and adjourned.
