The Visalia City Council on a 4-0 vote overturned the Planning Commission's condition limiting a proposed Hobbies restaurant drive-through to 10 p.m., approving the conditional use permit with the applicant's requested hours of operation (until 2 a.m.) for the drive-through.
Colleen Moreno of the planning division summarized the background: Planning Commission had approved CUP 2025-32 but added Condition 3 to limit drive-through hours because of proximity to single-family residential parcels north of the site. Moreno noted the drive-through speaker box would sit on the west side of the parcel along Stonebrook and that an acoustical analysis required for the CUP concluded project-related noise would not be expected to exceed existing ambient levels and that the project must comply with the city's noise ordinance.
Applicant Javier Maldonado, owner of Hobbies, urged approval and said the later hours were essential for viability and local employment: "I am just trying to provide employment for our local people," Maldonado said. He offered to work with the city and contractors to mitigate speaker volume if necessary.
Councilmembers who supported overturning the Planning Commission cited existing similar uses along the corridor, the submitted acoustical analysis, and an absence of nearby residents filing formal objections. One councilmember said nearby Jack in the Box operates 24 hours and the corridor is busy. The motion to overturn the Planning Commission's decision and approve the CUP with the applicant's hours passed 4-0, with Councilwoman Nelson absent.
