The Fountain Green Planning Commission voted April 9 to deny the Bailey garage and shop permit application and return it to the applicant with specific questions after members found conflicting setback measurements and insufficient documentation.
Commissioners found discrepancies between the site plan and other sheets: one drawing listed a 20-foot setback while another showed 25 feet. Members also could not determine whether the proposal was an addition to an existing, grandfathered structure or entirely new construction. That distinction affects whether the project can rely on prior setbacks. "We have questions about setback and demolition — whether there's an existing structure or not," a committee member said when moving to deny the application pending answers.
The applicant (Bailey) was not present. Commissioners said the applicant or a representative must attend the next meeting or provide documentation answering two primary questions: (1) clarify the discrepancy in setback figures on the drawings, and (2) confirm whether any portion of the existing structure will remain or whether demolition will occur.
The motion to deny carried on a voice vote. Staff will send a notice outlining the commission's questions and advising the applicant to attend the next meeting to answer them.
