The Washington State Board of Health decided not to open a preliminary investigation into a March complaint that alleged the Yakima Health District failed to enforce on‑site sewage rules at a Sunnyside meat processing facility.
The complaint, filed under RCW 70.05.012, alleged the facility operated a high‑volume meat processing operation on a septic system permitted for a small retail use and that the district did not act to enforce a required change of use. The complainant provided clarifying materials identifying specific district staff by name.
Yakima Health District interim administrator Ryan Eibach submitted a written response explaining multiple inspections, coordination with the Department of Health, Department of Ecology and Department of Agriculture, and water sampling; the district reported no evidence of a failing septic system or unauthorized discharge. Department of Health wastewater management staff also engaged with Yakima and the complainant during the review.
After asking whether additional inspection reports should be pursued, members concluded the district had documented investigations and that state follow‑up found no public‑health threat. Member Steve Kutz moved that the complaint did not merit a preliminary investigation; the motion was seconded and adopted by the board.
Shay Bauman, staff to the board, noted that the board’s jurisdiction under the RCW is limited to appointed local health officers or administrative officers and that additional materials could be reviewed if the board later authorizes a deeper investigation.
