Senator Myers presented Senate Bill 276 as a targeted accountability measure for bail bond producers, saying the measure fills a gap that allows a producer to be appointed with a new insurer while unresolved forfeitures or judgments remain from prior bonds.
Under the bill, a producer seeking appointment with a new insurer must file a sworn pre-appointment affidavit; a former insurer may submit sworn notice with supporting documents if liabilities remain unpaid, which would require cancellation of the new appointment until liabilities are discharged. The bill preserves an appeal to the commissioner and directs the Department of Insurance to adopt implementation rules.
Steve Adams, identified in committee as president of the Association of Louisiana Bail Bond Underwriters, attended and offered to answer technical questions. Senator Bass raised the fiscal-note question and the sponsor said the bill will be dual-referred and staff will work with the Department of Insurance on implementation details. Senator Bass moved that the committee report the bill favorable; the motion carried without recorded opposition.
The committee reported SB276 favorable and the bill will proceed to further referral as required by process.
