Brazos River Authority authorizes up to $300,000 more for experts on Lake Whitney reallocation

Following a closed executive session to consult with counsel on pending or contemplated litigation under Texas Government Code §551.071, the Brazos River Authority board reconvened in open session on March 30 and approved a resolution authorizing additional spending tied to the Lake Whitney reallocation project.

Staff recited background that in July 2025 the board had previously authorized $500,000 for legal services by Johnson Fortuna LLP to support the authority in the Whitney reallocation matters. Staff told the board that continued third‑party challenges and evolving needs could require expanded legal services and potential retention of specialized hydropower, legislative or economic experts. The resolution authorized the general manager/CEO to expand an additional $300,000 for such expert services to facilitate negotiations with third parties and achieve final authorization of the Lake Whitney reallocation project by the U.S. Army Corps of Engineers.

The resolution was read into the record, a motion to adopt was made (mover: Director Huber; second: Director Henderson) and the board polled and approved the measure.

The authorization is framed as a funding expansion to support negotiation and litigation readiness, and staff said it will be used as needed to advance authorization with the Corps and address outside challenges.
