City staff presented a title report showing no additional encumbrances on the Krabby’s Dockside land lease, prompting discussion about next steps for a tenant that vacated and left unpaid obligations.
Why it matters: The restaurant sits in a marquee downtown location and commissioners said getting it reopened quickly is critical to downtown revitalization and tax revenue.
Cheyenne Harnage, director of community & economic development, said the report shows the leaseholder is the sole titleholder on the land lease and there are outstanding amounts owed to the city. Commissioners discussed three tracks: accelerate lease termination and pursue damages; seek an assignment (transfer) of the lease to a new operator with commission approval; or pursue settlement or sale options. City Attorney advised that assignment is permitted in the lease but requires the commission’s written approval and public comment at a future meeting.
Several commissioners urged a short window for the current tenant to present an assignment plan; others argued the tenant had already declined assignment offers and preferred immediate termination and a prompt solicitation for a new tenant. The city attorney said she is in communications with the tenant’s counsel and will report back. No formal motion to terminate was taken at the meeting; staff were asked to continue settlement and assignment negotiations and to return with recommendations at the next meeting for either a resolution or to begin termination procedures.
