The Marshall County Planning Commission on March 26 recommended approval of a three-lot minor subdivision for a roughly 67-acre parcel on Olive Trail in Plymouth, allowing the three tenants in common to hold individual ownership of equally sized lots. Staff told the commission the proposal meets subdivision regulations and preserves natural features, and added an easement for the rear parcel to preserve access.
The petitioners were represented by attorney James Easterday, who said the property was inherited by the three owners as tenants in common and that they want separate titles so "they can each collect their own rents." A petitioner told the commission it was her mother's wish that the property be divided among the three heirs and that the split is "all legal."
Commissioners asked about a tile and easement affecting the back lot; the attorney agreed to ask the surveyor to show the tile on the plat and to bring a corrected plat back for signature. The commission discussed maintenance of ingress/egress easements and was told the drafted easement language would likely require joint maintenance "at the expense of the property owners."
A motion to approve 26-PC-1 passed by voice vote and the chair indicated staff will receive a signed plat after the surveyor updates it to show the tile and easement. The action is a planning commission recommendation; final recordation and any permits depend on subsequent county review and recording.
