Punta Gorda City officials approved an outdoor dining application for Harvest and Rolls Deli Creamery after staff and the applicant clarified door-clearance and impact-fee rules.
The item, listed as OD022026, was introduced by the chair and reviewed by several staff members. A building staff member emphasized that each exit door leading to the parking lot must maintain a 44-inch clear opening measured "from the middle of the opening," and that exit paths must not be obstructed. "Just can't obstruct going straight out into that parking lot or emergency coming in from the parking lot," a staff member said.
The applicant, who identified himself as Timothy McGinney, asked whether the 44-inch measurement was taken across the closed door and whether the 48-inch spacing referred to the distance from the edge of the table to the edge of the parking lot rather than to the building. "So as long as that's maintained," McGinney said, "there's no problem."
Rachel Berry, the zoning official, clarified the applicable accessibility and fee requirements. "There does need to be a 48 inches wide path between the pillars and the tables even when customers are sitting in those chairs," Berry said. She also explained the local impact-fee threshold: if outdoor seating exceeds 15% of indoor seating capacity, additional impact fees may be due.
After the clarifications, the chair asked for a motion. Rachel Berry said she would approve; the motion was seconded and the body voted in favor. "Motion carries," the chair announced.
The approval is conditioned on maintaining the required clearances and complying with any applicable permits or fees noted in the staff report. The meeting then moved to the next agenda item.
