Senate committee advances juvenile commitment review task force, adds limited extension authority for assaults on staff

The Senate Finance Committee advanced Senate Bill 1868 on March 31 after adopting an amendment that creates a juvenile commitment review task force and adds limited extension authority for certain adjudicated delinquent youth.

Sponsor Senator Wally said judges increasingly place youth into Department of Children’s Services custody under dependent/neglect findings when no appropriate delinquency placements are available, creating a mismatch between needs and services. The amendment requires a task force — including DCS, juvenile judges, the Department of Mental Health and other stakeholders — to convene and report recommendations by February 1 on service gaps and how to address them.

The amendment also allows juvenile courts, after a hearing and with counsel present, to impose an additional up to six‑month extension for a youth who is adjudicated delinquent and who assaults a staff member while in residential placement; the total commitment under the modification would not exceed 12 months for the underlying case. Supporters described the change as a limited additional tool to address violent behavior in placements; members questioned definitions, due‑process safeguards and whether a study should conclude before adopting the extension authority.

Committee members discussed fiscal estimates and the presence of recent studies pointing to service shortfalls; sponsor and other members said the task force will help shape long‑term policy. After debate the committee recommended SB 1868 as amended for passage to the calendar (roll call reported 9 ayes, 1 no, 1 present not voting).
