At a local planning commission meeting, members voted to adopt a pending-ordinance approach that pauses parts of subdivision approvals while staff and contractors finish supporting forms and checklists. Committee member (speaker S4) moved for adoption and to allow staff member Sharada to post the measure for public notice; committee member Kevin (speaker S2) seconded the motion, and the commission voted in favor.
The measure is intended to preserve the council's ability to refine appendages to an already-approved ordinance without upending existing vesting rights, Presenter (speaker S1) said. "This is what we refer to as a pending ordinance issue," the Presenter said, adding that it "preserves the council's right to continue to refine things that are already there but within a limited time."
Chair (speaker S3) and others clarified that the ordinance itself would not be rewritten; instead, the town would update the supporting forms and checklists that accompany the subdivision ordinance. The commission discussed using the pending status to "pause" certain permitting steps—an interim measure described as protecting the planning commission and town board from possible lawsuits while they complete the supporting materials.
Under the motion, staff was authorized to publish public notice of the pending ordinance so the community can be informed while the commission finalizes the related forms. The motion passed on a voice vote, with members indicating their approval.
The commission said it expects to return with the refined forms for final review once engineering and legal details are complete. The next regular meeting was set for April 29.
