Council denies appeal of short-term rental permit reissuance for 804 Henry Pettus Street

Council denied an appeal from the owner/operator of a short-term rental at 804 Henry Pettus Street after staff said the property’s transfer to a trust resulted in an ownership change that exceeded the code threshold for reissuance.

Dane Leach (appeal applicant) told council the transfer to a family trust was an attempt at legacy planning and said any failure to complete the transfer paperwork was inadvertent. Planning and code staff told council that the change in ownership exceeded the 50% threshold that triggers a requirement to reapply and that the director of development services therefore declined to reissue the permit.

Council moved to deny the appeal and the motion carried by voice vote. Council noted the property was listed for sale, which one councilmember said could affect reconsideration in the future.
