At a board meeting, the BCA voted to authorize its counsel to coordinate with other Clark County municipalities and pursue a court injunction against Andy's Roofing and Andy's Realty for placing temporary signs in the public right of way.
Counsel to the BCA told members the companies “ignored the town's demand to stop placing signs in the public right of way,” saying the town had sent notices of violation and offered the companies 10 days to request a hearing. Counsel said the repeated placements have cost the town money and forced town employees to remove signs from the middle of intersections, creating a safety risk for those workers.
Counsel proposed a motion that would authorize counsel “to coordinate with other Clark County municipalities in initiating an injunction action against Andy's Roofing and against Andy's Realty for placing signs in the public right of way and to seek an injunction prohibiting them from doing that and to recover the costs of the town.” A motion was placed before the board and seconded; a board member recorded the second as “Floyd.”
A member asked whether the injunction would apply to others who place signs; counsel clarified the motion named only the two companies and explained that an injunction is a court order compelling compliance with the ordinance and that violation could lead to contempt proceedings or fines. Counsel also noted that the UDO still applies to anyone placing signs in the public right of way.
The chair called for the vote; the motion carried 3-0. Counsel offered no additional comments, and the board adjourned the meeting at 7:04.
The board directed counsel to proceed with coordination and legal steps to seek the injunction; no notice of a court filing or dates were provided in the meeting.
