Vienna council adopts zoning and subdivision code updates, sets effective date tied to publication

The Vienna Town Council voted unanimously March 23 to adopt a set of zoning and subdivision code amendments the town has been reviewing since September 2025. Director Levy told the council the language before members was the same as advertised and staff recommended an amended motion clarifying that the changes would become effective 10 days after publication of the notice.

The amendments cover multiple code sections the council reviewed at its Feb. 23 meeting. "If we say 10 days after the publication, then we'll know that's when it's effective," Director Levy told the council while explaining the town clerk would publish the notice in the paper.

Council members raised technical questions during discussion. Council member Baldwin questioned whether a new exclusion for walkways and sidewalks (5 feet or less) would inadvertently count some existing sidewalks against lot coverage for nearby homeowners. The town attorney cautioned that a suggested rewording about parsonage and rectory location appeared to be a substantive change that the planning commission had not considered; councilors agreed to defer any substantive parsonage/rectory amendment for further study rather than adopt an unadvertised change.

After brief discussion, a councilor moved to adopt the changes as presented and to direct the town clerk to advertise a notice of adoption with the effective date set as 10 days after publication. The motion passed unanimously.

Next steps: the clerk will publish the notice, triggering the effective date; staff and councilors indicated they will revisit parsonage/rectory language and other zoning items in a future code-update package.
