The Planning & Zoning Board on April 18 approved a variance permitting a 10‑foot street‑side setback for a swimming pool at 398 Northeast 23rd Street.
Neli John, zoning officer, presented the request and said the property’s existing house and previous additions prevent a pool from being placed in the rear yard, leaving the side yard along Northeast 4th Avenue as the only feasible location. John told the board the variance would allow construction of a pool and deck and that staff supported the request as the minimum relief necessary to allow reasonable use of the property.
“Granting this variance will not be detrimental to the public welfare due to the surrounding neighborhood having single family homes with pools on their properties,” John said during the presentation.
There were no public speakers. The board moved to approve the variance and recorded a unanimous roll‑call vote (6–0).
The approval allows the applicant to proceed subject to the standard conditions listed in the staff report. No appeals, enforcement actions or timelines were announced at the meeting.
