Fairfield’s Planning Commission voted to table the Lovelandills site plan at its March 19 meeting after staff and legal counsel said the plan lacked required sign-off from the irrigation/ditch owner for a proposed fence setback. Chair (speaker 2) opened the meeting and commissioners discussed a layout discrepancy where the applicant believed it had 10 feet to a fence but a ditch runs between the properties.
Commission members and counsel said approving the site plan without written consent from the ditch/irrigation authority could create enforcement and liability problems if foundations were poured and later the irrigation company required the ditch to be left open. Planning/legal advised conditioning approval on receiving the irrigation company’s written sign-off. Commissioner (speaker 1) moved to table the Lovelandills site plan and a second followed; the motion carried on a roll-call vote with commissioners recorded as voting in favor.
The tabling pauses formal action while staff and the applicant obtain the necessary irrigation company consent so the commission can consider an approved plan that does not infringe on the ditch. The commission did not set a new date for the item but indicated it will return to the plan once the requested documentation is provided.
The commission adjourned its discussion of the Lovelandills site plan pending the applicant’s submission of the irrigation/ditch sign-off.
