"If we sweep these funds," Storer said, "we would be putting the council and ultimately the state at risk for a legal challenge in failing their diligence in managing the conservation easements they legally hold."
Supporters noted the amount at stake is modest (about $34,140 in the easement-defense fund), but argued that the fund serves as insurance against potentially expensive litigation that could arise if easements are challenged. Senators who raised audit concerns said the council had corrected previous bookkeeping issues, and several emphasized the difference between punishing a past administrative lapse and stripping an entity of funds needed to meet legal obligations.
Following debate, the amendment passed on a roll call and the floor moved on to other budget items.
