The Rio Rancho Planning and Zoning Board on March 10 approved a variance allowing a 4.5‑foot encroachment into the five‑foot R1 side setback for a proposed 300‑square‑foot shed at 2332 Manzano Loop NE, after hearing a staff recommendation to deny the request.
City planner Tim Dvorak told the board staff recommended denial, saying the lot does not have an exceptional physical condition that prevents compliance with the zoning code and describing setback requirements for R1 single‑family lots. Dvorak summarized the request: the proposed 300‑square‑foot structure would measure roughly 30 by 10 feet and stand about 10 feet in height; the submittal referenced building permit number 25‑12027 dated 12/11/2025. "As the lot is not irregular in shape, narrow, shallow or steep, and does not have an exceptional physical condition that prevents the applicant from complying with the zoning code," Dvorak said, staff found the variance criteria were not met.
Applicant and property owner Andrew Riley said he sought the variance to gain access to his backyard and to place a movable shed. "I am asking for that variance because of the access to my backyard and particularly just to build a shed," Riley said, adding he had spoken with nearby neighbors and that the property backs to the Rio Grande Bosque public space, reducing the likelihood of future utility relocation behind the lot.
Neighbor Rob Kropower of 2336 Manzano Loop NE spoke in support, saying he and his wife did not object and noting similar sheds in the area. The board questioned the applicant about fence height, roof design and drainage; the applicant described a parapet roof to match the house and drainage directed toward the street.
After public comment and deliberation, the board voted to approve the variance. The roll call recorded five yes votes and one no (Commissioner Gabaldon), and the motion passed. If the applicant proceeds, franchise utilities must sign any encroachment agreement and the applicant must address remaining building department review comments.
