Morgan County Planning and Zoning Administrative Assistant Cheryl Brindisi presented Resolution 2025 BCC 54 to rezone parcels owned by Randall and Rhonda Jess and adjoining land, changing multiple parcels in the SW¼SE¼ of Section 25 and parts of Section 26 (Township 4 North, Range 58 West of the 6th P.M.) to Agricultural Production (A).
Brindisi said the Planning Commission held a public hearing on Dec. 8, 2025 and recommended approval by a 5-0 vote (one member absent). The resolution record shows that the Deuel and Snyder Ditch Company owns a parcel surrounded by the Jess properties and provided written consent to include that parcel in the rezoning. The Board found the rezoning consistent with the Morgan County Comprehensive Plan and compatible with surrounding zone districts, and it approved the application on a 3-0 vote. Commissioner Kelvin S. Bernhardt moved approval; Commissioner Timothy A. Malone seconded.
The resolution lists the specific parcels and zoning changes, converting areas previously zoned Rural Residential, Moderate Density Residential and Estate Residential to Agricultural Production. The resolution states the change will protect agricultural uses and notes constraints on development in the area (lack of access and terrain).
