The Finance Administration Committee on Monday moved to forward to full council a resolution proposing that the city accept $110,000 from Laurel Park LLC to terminate a municipal lien established by an earlier council resolution.
City legal counsel (S9) told the committee that legal fees incurred so far are "around $13,000" and cautioned that pursuing foreclosure is uncertain and would add expense. Counsel also said, "the appraised value of the land is approximately 300,000, give or take a smidge," noting that recovery in foreclosure would depend on what bids bring at a sale and would be reduced by legal costs.
A committee member (S4) objected to the offer. "I think the $110 is too low for us to take," the member said. Members debated whether the expense and time of continued litigation would likely exceed the benefit of holding out for more money.
Counsel said the administration agreed not to bring offers below six figures to the committee for review; anything above six figures would be considered. The committee ultimately forwarded the settlement offer to the full council; the transcript records discussion but does not record a committee vote tally.
