The applicant's representative told the board the building expansion on the east side of Lot 27 would not meet the current Unified Development Ordinance setback because the existing front setback is about "46.4 feet," not the 60 feet required under the UDO. "The request is relief of the 60 foot setback requirement for the front setback for this building," the applicant's representative said, explaining the variance is needed to make the expansion compliant with the prior condition on the lot.
A staff member confirmed the board had a physical copy of the submittals and presented the staff recommendation before the board moved to admit evidence. The chair formally moved to admit all materials related to hearing BZA2026001 into the record, and members voted in favor.
A board member moved to approve variance BZA2026001—described in the hearing as relief from "section 10-02-23(a) front yard setback to allow an existing building to encroach"—and the motion passed 4-0. Afterward the chair directed corporate counsel to prepare written findings of fact reflecting the board's decision.
The board's action will be recorded in adoption of findings and the applicant was told to coordinate with staff and the planning commission on the next procedural steps. Final action was scheduled for two weeks, after a forthcoming planning commission step.
