Panel finds Transportation Cabinet's online insurance-verification rule deficient

The joint subcommittee voted to find the Transportation Cabinet's proposed real-time online insurance-verification regulation deficient after staff said parts of the draft appear out of alignment with legislation enacted last year.

Assistant general counsel John Johnson and Commissioner Matthew Cole presented the proposal for 601 KAR 91:120, describing a real-time insurance verification system. Chair Lewis said staff from the legislature's banking and insurance division had identified alignment issues between the proposed regulation and a bill passed by the General Assembly last year and that he intended to call a deficiency motion.

When the motion came to a vote the chair read the roll and later announced, "With 6 ayes, 2 passes, the motion to find this regulation deficient has passed." He encouraged the Transportation Cabinet to work with committee staff to resolve the listed concerns.

What happens next: the Transportation Cabinet was asked to work with legislative staff to refile or revise the regulation to align with the statute before the committee will consider it further.
