The Mount Clemens City Commission voted Aug. 7 to adopt a resolution asking state legislators to repeal House Bill 4244 (Public Act 256 of 2011), the state’s fireworks statute, and to reconsider statewide rules that limit local authority.
City staff introduced a resolution offered by Macomb Area Communities Regional Opportunities (MACRO). The resolution asks the state to revisit a law that allows fireworks on specified holiday days and, according to supporters, constrains municipalities' ability to regulate fireworks at the local level.
A speaker associated with the regional group explained the measure is "merely a resolution" asking that the present act be repealed so that a renewed statute could be developed with more local input. Supporters told commissioners the law has limited local control, increased nuisances such as noise, debris and air-quality concerns, elevated 911 call volume and risk of injury and property damage, and placed stress on police, fire and public works services.
Commissioner comments reflected concern about enforcement limits and repeated problems with fireworks outside designated dates. After discussion the commission adopted the resolution by roll call.
The resolution will be forwarded to state legislators and the governor as a formal expression of the commission’s position. The resolution does not change local ordinance language; it is a request to the Legislature to revisit the state statute so municipalities could seek different statutory language governing fireworks.
