Mount Clemens approves 41-B District Court 2020 budget; court rep addresses caseload drop

The Mount Clemens City Commission voted to approve the 41-B District Court budget for 2020 on Dec. 16 after a court representative described recent caseload fluctuations and state funding mechanisms.

A representative for the court (Jim McGrail) spoke for Chief Judge Carrie Lynn Fuca and Judges Sebastian Lucido and Jacob Femenino, apologizing for Judge Fuca’s absence and offering to answer questions about the proposed budget. McGrail said the court saw a "significant" 12% caseload drop in 2018 but reported the caseload had returned to expected levels during the current year. He said that when the court accounts for indigent-defense-related services it submits a grant request to the state; the state has mandated initial standards for implementation and the court expects future years to include additional standards.

McGrail told commissioners that, since consolidation, the court has returned approximately $2.5 million to local communities over the past decade. Commissioners asked about fines, court costs and the permanence of the Michigan Indigent Defense Commission fund; McGrail described that fund as a state-administered grant request process that the court anticipates continuing.

After discussion the commission approved the court’s 2020 budget by roll call.

Next steps: The approved budget will be administered by court staff; commissioners did not propose amendments at the meeting.
