Senior county counsel briefed the board that Washington County participated in a pretrial mediation in Eugene for a class-action habeas corpus case filed in 2023 involving the county jail.
Counsel said the county is currently subject to a restraining order that requires the release of unrepresented individuals held in the county jail if they do not receive defense counsel within seven days of being brought into custody. "The county has no part in providing or assigning defense counsel, nor can the sheriff release individuals under her own authority," the counsel said, describing the constraining legal dynamics and the resulting exposure for the county.
Counsel reported that mediation before Judge McShane was "very productive" from the county's perspective and that the state of Oregon, which is also a party, participated. The mediation will continue at a later date; counsel said a more thorough update will be brought to the board in a different format.
