The Lake Forest Planning Commission voted to approve a use permit for Creative Outlet Performing Arts Center at its March 5 meeting after an extended discussion about parking standards and whether the studio should have been operating while its application was pending.
Planner Jennifer Manser presented the application as a competitive dance training facility proposed for a tenant space in a Foothill Ranch business park. Staff categorized the use as an "indoor athletic facility" under the municipal code and, because the code lacks a specific parking standard for that use, recommended a site‑specific parking cap based on precedent from similar approvals: 21 stalls on the tenant site translate to an occupancy cap of 45 students, instructors or employees for parking purposes. Staff recommended conditions including the 45‑person parking cap, staggered start/end times to reduce overlap, restrictions on recitals or competitions, and a requirement that the applicant take remedial measures if parking issues arise.
The applicant, a Lake Forest resident who said she has operated the studio for seven seasons, told commissioners that early minor parking issues were resolved and described personal circumstances that delayed parts of the permit process. She said staff were responsive during that period.
Commissioners debated how to apply the municipal code’s parking provisions. Commissioner Van Wolk argued the use should align with the code’s dance‑studio parking standard and asked for an HOA letter allocating 40 parking spaces during the studio’s operating hours so the campus could meet the stricter ratio; Commissioner Van Wolk said consistency with municipal code was important. Staff and other commissioners noted the tenant area functions as industrial condominiums with shared parking and that staff has exercised discretion in similar prior approvals. The city attorney pointed to a code provision (9.168.07.B) allowing the director to determine off‑street parking where the use is not specifically described in the code.
A motion to approve staff’s recommendation was made and seconded. The commission approved the use permit; the minutes record one dissenting vote by Commissioner Van Wolk. The motion was described on the record as approval of the staff recommendation.
The commission’s action included standard conditions related to parking management and event limitations; staff retained authority to address future parking complaints per the conditions of approval. The applicant said she would follow up with staff as needed.
