A board member recounted a prior federal lawsuit after the district denied a student’s request for a service dog, telling the committee the district “got sued 1 time … We end up getting sued. We lost $750.” The speaker emphasized the importance of ensuring the regulation aligns with state law so the district does not repeat that outcome and referenced the student’s accommodations and individualized education program (IEP) context.
Staff responded that the regulation includes a legal cross-reference to the relevant Missouri regulation in the footer and that the district consulted counsel (Bo Tomachek) and reviewed MSBA recommendations while drafting the regulation to ensure alignment with state and federal requirements. Staff said that review was a primary reason no substantive edits were recommended for that regulation.
Committee members and staff also noted privacy constraints; the board member who recounted the case declined to name the student during the public meeting. The subcommittee asked staff to double-check adoption dates listed in the packet and otherwise folded the service-animal regulation review into the packet moving toward board readings.
The subcommittee did not take a formal vote on the regulation during the meeting; staff indicated the regulation will be included in the packet that goes to the full board for consideration.
