Town staff presented and the council approved an addendum to a March 4, 2024 memorandum of agreement with the Palm Cove Owners Association that makes three primary changes: it allows the town to designate a project manager and have the HOA/property owners association cover that cost; it replaces the town's previously listed attorney with the current legal representative; and it assigns responsibility for dredge spoils placement to the HOA rather than using Majestic Oaks as a staging/dumping area.
"All we're doing is we've identified that in the original memorandum of agreement that was signed in 2024 that it stated that the town would provide a project manager. We no longer have that capacity," staff member (speaker 6) told the council, explaining the operational change and that related fees will be transferred to the property owners association.
The staff member also said the addendum clarifies where dredge spoils will go; the council previously used Majestic Oaks as a staging area and the change ensures those spoils will instead be the HOA's responsibility. A council member said the addendum was the result of detailed review and hours of work by staff and council.
