The North Bend Planning Commission held a code-cleanup work session Feb. 23 that focused on setbacks for accessory structures, rules for small structures under 200 square feet, and how the city should measure vision-clearance areas at intersections.
Derek, the city building official (attending at staff request), explained the interplay between building code and zoning. He said structures under 200 square feet may not trigger building-code permitting and therefore can fall outside zoning setback enforcement unless the zoning code explicitly regulates them. "If it was smaller than 200 square feet, it may or may not have required a building permit... you can put it anywhere on the lot," Derek said, noting that zoning could impose its own setback standards and variance processes.
Commissioners and staff discussed public-safety tradeoffs, including fire-spread risk where structures sit on property lines and the existence of many preexisting, nonconforming structures. Derek said the fire department typically regulates existing structures after construction is complete, while building permitting governs new regulated structures.
The commission also debated how to measure the vision clearance area (VCA). Derek recommended measuring the triangle from the street — "the improved margin of the street, whether that's the curb or the edge of pavement" — and proposed 20-foot legs for the triangle based on vehicle-code guidance to improve driver sight lines.
Commissioners asked staff to return with concrete setback numbers, visual diagrams showing how different setbacks would look on typical North Bend lots, and suggested drafts that could then be reviewed in a subsequent work session before staff prepares a public hearing packet. Staff also announced an upcoming comprehensive-plan update, planning-commissioner training and consulting work on a downtown action plan.
Next steps: staff will prepare maps, recommended setback distances and a draft amendment for the commission's review at a work session ahead of a formal public hearing.
