Committee advances bill encouraging mental‑health assessments before juvenile adjudications

Senate Bill 35, introduced by Senator Fevella, would allow a judge to require or request a mental‑health analysis or disability needs assessment before adjudicating a delinquent juvenile, with a 72‑hour safety valve if a recent social analysis already contains the information. The sponsor said the measure reinforces rehabilitative aims of juvenile code and promotes diversion and treatment over detention.

Committee counsel asked how the proposed assessment differs from a social history; the sponsor said some social histories are incomplete and the bill accounts for that by letting the judge rely on an existing comprehensive social analysis if present. The subcommittee voted to report and refer SB35 to appropriations by unanimous voice vote.
