The New Jersey Pinelands Commission on Feb. 13 approved a waiver application allowing development of a single-family dwelling on a 1.8-acre lot in Jackson Township’s Highlands Regional Growth Area.
Staff presented an aerial and explained the application requests a waiver from the commission’s 300-foot buffer requirement. Staff noted commission waiver rules are stringent, requiring a set of tests for ‘‘waiver or strict compliance’’ and that all lands in common ownership must be included in the application. In this case the property owner owned two lots and the dwelling was proposed for the northern lot; staff confirmed the project met the requirement for on-site septic by meeting the five-foot seasonal high-water table depth standard.
A commissioner moved to approve the resolution and the motion passed on a voice vote. Staff reiterated that the commission grants a limited number of waivers annually and that each application must meet statutory and regulatory tests before approval.
