Committee advances SB 141 to clarify child-welfare procedures and expand kinship rules

Sen. Harper introduced the second substitute of Senate Bill 141, calling it the chamber’s annual cleanup for child-welfare law and saying stakeholders — including Department of Child and Family Services (DCFS), guardian ad litem representatives, and parental-defense advocates — helped shape the changes.

The bill clarifies procedures in juvenile-court cases to improve safety, transparency and timeliness. Harper said the measure authorizes DCFS to expand the statutory definition of relative caregivers by rule (removing a rigid list such as “brother‑in‑law,” “sister‑in‑law,” “first cousin” when more flexibility is warranted). It also requires that certain findings — for example, emergency-removal findings — be submitted to the court rather than retained only in administrative files, a change the sponsor described as adding transparency to emergency removals.

A public commenter thanked the sponsor and said improved rules will help with foster-placement decisions and interagency communication. Representative Acton moved that the committee favorably recommend the second substitute; the sponsor waived remarks and the committee adopted the motion by roll call. The committee recorded the outcome as a unanimous favorable recommendation to the House floor.

The committee did not adopt any amendments in committee. The sponsor and stakeholders signaled they will continue to coordinate implementation details with DCFS and legal stakeholders before floor consideration.
