The Planning Commission recommended approval of a change of conditions and a conditional use for a retail package store selling distilled spirits at 4800 Columbia Road.
Staff told the commission the two‑part application sought (1) to remove an earlier condition that limited the parcel to a convenience store with fuel pumps and (2) approval for a retail package store. Staff noted the site meets recent distance and separation requirements — including a roughly one‑mile separation from the nearest package store — but recommended disapproval because the parcel lies within a neighborhood character area on the county’s future development plan and lifting the restriction would expand commercial development beyond the plan’s intent.
The applicant, who identified himself as a co‑owner of the business, said the parcel’s adjacent vacant land is planned for future development and that lifting the condition would allow the owners to open a liquor store and remain competitive with an applicant seeking a nearby liquor permit. “We do we do sell beer and wine,” the co‑owner said when asked about current sales. He told the commission the proposed store would have similar retail sales to other convenience‑style operations but would not include fuel sales.
Neighborhood opposition focused on preserving the character of adjacent residential streets. Christopher Valentine, who said he lives at 162 South Old Bel Air Road, urged the commission to maintain the prior condition because the restriction represented a deliberate compromise when the site was first approved. “You put that there so something like this couldn’t happen,” Valentine said, and warned that removing the condition could allow future expansion closer to homes.
After public comment, a commissioner moved to recommend approval of the change of conditions and then to recommend approval of the conditional use for off‑premises distilled‑spirits sales. Both motions carried unanimously.
The commission’s action is a recommendation; the Board of Commissioners will take final action on rezoning and related requests on 11/19/2024. Members of the public who wish to speak at that meeting were told to contact Ms. Staller for a request‑to‑speak form.
