The Lawrenceburg Redevelopment Commission on Feb. 9 gave conditional approval to a contract for the sale of 236 East High Street to a prospective buyer who submitted a contract through Mr. Loemiller.
Staff said the agreement is contingent on a zoning change, submission of final building plans, approvals for any needed building-height variances or curb cuts, and other standard contingencies. Staff described the property as a small, long-listed lot on East High and said the contract price is $12,500 (the board had previously discussed a $15,000 asking price).
A commissioner asked whether serving on the Board of Zoning Appeals (BZA) would create a conflict if the same commissioner later had to consider variances for the project. Legal counsel and staff advised that dual roles are common and not necessarily a conflict unless an individual is unable to fairly and objectively decide; the staff reiterated that the planning commission and BZA processes will be followed rather than the city unilaterally rezoning the property.
The commission moved and approved the conditional sale; staff said they will proceed with the zoning steps, request final plans from the buyer and return with required approvals as the process continues.
The motion recorded in the meeting provides conditional approval only; final authority to permit building-height variances or to approve final construction plans rests with planning and BZA proceedings or other applicable review processes.
