Bill would let cities, counties recapture convention-center grants if businesses leave target areas

Senator Carol Spivey (introduced as Senator Spivey in committee) told the Revenue Committee LB 852 is intended to strengthen accountability for publicly backed financial assistance tied to convention-center development and turn-back tax programs. The bill would give political subdivisions the option to recover a prorated portion of funds when a grant recipient fails to keep its principal place of business in the award area for three years.

Spivey said the bill does not change the underlying financing structure but provides local governments discretion to recapture funds if recipients close or move. She described a recent instance in which a business slated to receive a grant closed before finalizing paperwork; that experience prompted outreach to county officials and the policy proposal.

Committee members asked whether the bill would create proactive monitoring responsibilities or simply allow contract language changes. Spivey said the change in statute would let counties and cities add contract provisions requiring disclosure and monitoring during the three-year period; if a locality chooses not to recapture, it retains that discretion.

No proponents or opponents appeared in the room; the sponsor reported no online comments and said the Nebraska Association of Counties and Douglas County lobbyists had expressed no opposition during outreach. The committee closed the hearing with no immediate action.
