The Titusville Planning and Zoning Commission voted to approve Right-of-Way Vacation No. 4-2025, allowing the vacation of unimproved portions of Yale Street and a portion of Zurich Avenue at the northwest intersection of Elizabeth Avenue and Queen Street, with a condition that an easement be recorded to preserve an existing water stub-out.
Senior planner Christy Anderson told the commission staff’s review found "no public purpose for vehicular or pedestrian access, and no environmental impacts are anticipated by the proposed vacations," and recommended approval provided the easement for the water stub-out is included. Anderson also reported that utilities including AT&T, Florida Power & Light, Florida City Gas and Spectrum submitted letters of no objection.
During the public hearing the developer’s representative said predevelopment teams include local engineers and that the landowner is a structural engineer from northern Titusville; the representative said the developer has secured a construction loan and estimated breaking ground in about 8 to 12 months, pending permitting.
A motion to approve the vacation with the easement condition was seconded and carried on a roll-call vote. The commission recorded the following affirmative votes: Member Garad, Member Seidler, Vice Chairman Childs, Member Gallen, Member Trautman, Member Faison and Chairman Nathan. The motion carried and the easement condition will be included in the recorded approval.
Staff noted that after a right-of-way vacation the county property appraiser will reassign property lines—typically splitting a vacated right-of-way along the center line so adjacent property owners receive half of the right-of-way—but the precise allocation depends on the recorded plat and any subsequent replats, an issue staff said would be finalized by record and appraisal processes.
