The City of Box Elder Planning Commission voted unanimously to recommend that the City Council approve Resolution 26-07, a petition to vacate a portion of the major drainage easement on Lot B and Lot C of Track 3 in Burger Subdivision.
Lori Patton, planning and zoning director, told the commission the applicants are within the city’s planning jurisdiction though not inside city boundaries and that the applicants own both properties involved. Patton said the city engineer reviewed stormwater flows and consulted the project engineer and had no issues with the proposed adjustment. "They're not in our city boundaries. They're looking to adjust the boundaries of their major drainage easement... Our city engineer reviewed the flows... and he had no issues with this adjustment," Patton said.
An applicant identified himself as Daniel and noted a family member was present to assist. After the staff presentation, a commissioner moved to recommend City Council approval of Resolution 26-07 as presented; the motion was seconded and passed in a unanimous roll call.
The commission’s recommendation will be forwarded to the City Council for final action; the commission did not impose conditions other than the recommendation and noted coordination with Pennington County remains part of the process because of the applicants’ planning-jurisdiction status.
