The Elections Division presented a proposed regulation, now LCB R003-26P, that would require county clerks to conduct a post-election certification audit when a county used electronic tabulators and to transmit audit results to the Secretary of State within nine days after the election and before the county canvas.
Velaschin said the draft requires immediate notification to the Secretary of State if a discrepancy of four or more votes is discovered during the audit and requires clerks to investigate the cause of any such discrepancy; the draft also prohibits any member of the public observing an audit from interfering with its conduct.
Velaschin clarified that Nevada counties no longer use VVPAT devices in the way some jurisdictions historically did; most have transitioned to ballot-marking devices that provide a voter-verified paper ballot or separate printout the voter can inspect, and the regulation updates audit procedures to match current county practice.
