The State Public Charter School Authority on Jan. 6 voted to adopt rule changes proposed in LCB file R080-24 that restructure parts of NAC 388A governing how the authority accepts new charter applications, considers amendments and conducts renewals.
Director MacKinnon described the package as a reorganization that clarifies existing authority while changing a few operational dates. The board approved an amendment to the application cycle: beginning in 2027, applications to form a new charter will be due in January rather than the current April 15–30 window. The proposed language also removes the fixed amendment-cycle dates so charter schools may request contract amendments at any point during the year without a good-cause exemption, and it aligns renewal authorization to permit terms of three to 10 years.
Director MacKinnon told the board the revised R080-24 responded to prior legislative commission feedback and notably repealed the executive director’s approval requirement for schools submitting external academic evaluations as part of the renewal process, and it removed provisions allowing an abbreviated application for inexperienced prospective applicants.
Vice Chair Whitaker moved adoption; Member Holmes Sutton seconded. The vote was unanimous. The adopted regulations will be transmitted to the Legislative Commission and, if approved there, become effective under Nevada rulemaking procedures.
