Speaker 1, chair of the Jefferson County Board of Supervisors, opened discussion on Dec. 1 about placing a non-agricultural load embargo on County Road 146 to limit heavy commercial traffic.
Speaker 3, who presented the item to the board, said he circulated two relevant sections of the Iowa Code that counties commonly use to restrict commercial loads and to impose a seasonal vehicle embargo. He said crews had completed chip sealing and patching on Road 146 last summer, but after the county removed a bridge load limit traffic began using the route as a cut-through to a sand plant in Washington/Henry County, increasing wear on pavement beyond its capacity.
Board members debated how quickly to act and whether a resolution or an ordinance would be the appropriate vehicle. Speaker 1 asked whether the board could achieve a faster temporary restriction by resolution; Speaker 3 said he needs authority in place by spring to protect the subgrade as frost melts. Several supervisors said an ordinance may be preferable because it supports enforceable penalties and citation authority; Speaker 5 referenced a draft that provides for a $500 penalty in sample language.
The board agreed to prepare draft language, including signage and the list of roads to cover, and to place an item on the Dec. 8 agenda to set a date and time for a public hearing. No ordinance was adopted at the meeting; board members requested the written draft and legal review so the board can determine whether to proceed by ordinance (with penalties and ticketing authority) or by resolution for temporary limits.
The discussion made clear the board’s aim is to balance protecting pavement and infrastructure with providing lawful travel for legitimate local traffic. Next steps: staff will circulate a draft ordinance/resolution and supporting materials, and the board will consider setting a public hearing at the Dec. 8 meeting.
