Zoning Board Keeps Public Hearing Open on Davis Backyard Basketball Pad

Scott Davis told the Zoning Board of Appeals on Jan. 28 that he installed a concrete basketball pad about 1,500 square feet in size and invited neighbors to use it, but later learned the pad is treated as a structure requiring formal permit review. Davis described removing only a few small trees and said he wanted the matter resolved properly.

Board members noted the Planning Board had not yet issued a recommendation; because that recommendation was outstanding the ZBA opened the public hearing and then kept the hearing record open for the next meeting. Members also raised concerns that the pad may fall within a 100‑foot buffer associated with a nearby stream and that wetlands permits could be required during the building permit review.

The hearing is continued to the board's next meeting pending the Planning Board recommendation and any wetlands determinations.
