Laramie Board of Adjustment postpones variance after staff flags uncertified survey

The Laramie Board of Adjustment voted unanimously to postpone consideration of a variance request for property near the Laramie River after planning staff told members the survey submitted with the application was not a certified, stamped survey by a licensed Wyoming surveyor.

Planning staff told the board they and the applicant’s representative recommended postponement because the survey submitted during the review process lacked the required certification. “We are recommending that this is postponed,” a planning staff member said, citing insufficient time for staff review and the absence of the applicant’s representative.

The recommendation prompted board discussion over next steps and scheduling. Members debated whether to set a date-certain for resubmittal to avoid a new public-notification cycle; staff warned that, even with a date set, the item likely would not appear on the very next agenda because of notification timelines. A staff member also said they had attempted to reach the state transportation reviewer (referred to in the transcript as “y dot”) and had not been told the application was out of conformance.

Board members asked technical questions about which codes applied and the practical consequences if the survey ultimately showed noncompliance with setback requirements. A planning staff member said the relevant setback is a 40-foot setback from the right of way and that nonconforming manufactured homes would have to be removed or otherwise brought into compliance if the certified survey showed they violate the code.

With no public comment present, an unnamed board member moved to postpone the matter “until it’s brought back before us,” another member seconded, and the clerk called a roll vote. Pacino, Heiser White?, Moody, O’Toole, Schneider and Matamore all voted aye; the motion passed 6–0, with one vacancy remaining.

Separately, planning staff announced that a resolution to appoint a seventh member, identified in the meeting as Kendra Bowe, will be on next week’s agenda. The board then adjourned and reconvened as the Board of Adjustment.

What’s next: the variance will return to the board only after the applicant provides a certified, stamped survey and staff completes its review and scheduling requirements.
