Speakers cautioned the committee is closely watching a matter involving Monument Farms and the legal status of tile drainage, saying outcome could set a precedent for whether tile drainage is treated as a point‑source discharge under EPA rules.
"We're nervous… that sets a precedence," a coalition representative said while discussing tile drainage and its implications for farms that use drainage systems. The same speakers noted that, under current EPA standards, tile drainage is considered a nonpoint source but that a different interpretation could trigger new regulatory requirements.
Committee members said they plan to hear from Heather Darby soon on tiling and other technical issues. Earlier in the session the committee reported it had taken testimony on neonicotinoid pesticides and described Heather Darby's presentation as "absolutely, positively compelling, strong" testimony. An unidentified committee member said the panel was "very concerned about what happens in 2029," when new neonicotinoid‑related rules are set to take effect.
Speakers said they will continue to monitor litigation, administrative rulings and upcoming testimony and urged farmers and technical partners to engage in stakeholder discussions.
