Oliver County commissioners received an extended briefing on the BNI overpass permit and application process with the Public Service Commission (PSC). A project representative (Speaker 6) said the PSC expects local road authorities to provide written findings supporting any road-closure or road-modification approvals tied to mining or pipeline work.
Project staff described an 'overpass agreement' that would include project milestones, the county’s rights to inspect work, and reimbursement by BNI if the county hires outside engineering oversight. Commissioners discussed adding a requirement for routine engineer reporting (weekly or biweekly summaries of daily logs) and asked that the frequency be spelled out in the overpass agreement. The project contact said BNI will reimburse the county for engineering oversight if hired by the county.
Commissioners also discussed voluntary easements offered to two landowners for work outside the right-of-way; staff clarified that easements are voluntary and the county currently holds leases sufficient to proceed. No formal findings were adopted; Project staff asked whether the commission wanted findings prepared and the board requested more time and legal review. Staff were asked to provide the draft findings and to check the county’s legal position before the next meeting.
