The Conservation Commission on Jan. 21, 2026 received an update on enforcement work at two Cross Highway parcels where staff documented tree removal, disturbance of mapped wetlands and possible encroachment into a town access easement.
Staff reported that ground-level clearing along the frontage had apparently scalped regulated wetland areas and that seven mature trees were removed. A large concrete block retaining wall in the front of one parcel is buckling, creating a risk that structural failure could deposit material into the wetland. The commission's enforcement officer said notices of violation were served and that some enforcement steps have already been taken.
The officer told the commission the citation total for the matter has "surpassed $5,000, on the citation at 200 a day since Christmas Eve," and staff said counsel was preparing to file for an injunction to halt work on both properties. The commission will be updated as court filings and surveying work proceed.
What happens next
Huntington (surveyor) is scheduled to stake boundaries and staff will monitor staking to confirm the easement boundary; counsel will prepare injunction paperwork and the commission will receive updates when filings are made.
