Brevard County commissioners authorized the county manager to submit an application to the Board of Trustees of the Internal Improvement Trust Fund asking for a release of right of entry related to a 1940s deed restriction on a 72-acre wetland in the Jefferson Marsh mosquito impoundment area on Merritt Island.
Staff explained the title search for a recent county purchase revealed a deed exception from the 1940s that reserved rights for exploration of phosphate minerals, metals and petroleum. The requested release of entry would mean the state would not exercise its entry right on the property, but would not remove the underlying mineral rights themselves, staff said.
The county attorney's office participated in the purchase and staff described the risk as minimal. Commissioners asked clarifying questions about the effect of the release and then approved the resolution by voice vote.
No formal mining or exploration activity was proposed; staff said the action is limited to seeking a release of right of entry from the state, not to altering or extinguishing the reserved mineral interests.
Next steps identified by staff include submitting the formal application and following up with the state Trustees' office; no timeline for final state action was specified at the meeting.
