Subcommittee clears PCS for HB 1121 tightening oversight of aging and guardianship services

Representative Rizzo presented the committee substitute for HB 1121, saying it aims to improve long-term care access, oversight of area agencies on aging (AAAs) and guardianship enforcement. Key provisions described included: creating a single statewide pre-enrollment wait list for long-term care services using a frailty-based prioritization; strengthening Department of Elderly Affairs oversight of AAAs with corrective-action authority and procurement standards; narrowing executive compensation caps to CEOs/executive directors and limiting state/federal funds for certain pay; and expanding the Office of Public and Professional Guardians' authority to subpoena records and levy fines up to $500 per violation.

Rizzo said the bill requires the Department of Elderly Affairs to submit unredacted guardianship oversight records, including complaints and investigation reports, to the speaker of the House and the president of the Senate by Aug. 1, 2026 to provide legislative visibility.

Members asked why language creating a Florida Alzheimer's Center of Excellence was removed; Rizzo said another member carries that provision in a separate bill and they could seek to restore it if needed. Stakeholders including the Florida Public Guardian Coalition, the Florida Association of Area Agencies on Aging, and AARP waived in support.

Ranking member Robinson reiterated a request to monitor the Alzheimer's provision; the sponsor and vice chair closed in support. The PCS for HB 1121 was reported favorably, 14–0.
