Committee members discussed Article 13, which proposes acquiring easements for the Beewalt Trail by purchase, gift or eminent domain. The chair stated he had been told the easements are expected to be gifts and suggested the committee seek clarification from warrant authors.
Several members said including eminent domain language could change the legal vote quantum at Town Meeting and set a precedent the committee does not intend to approve. John (Arnold) explained that if eminent domain were an option, a higher vote threshold (for example, a two-thirds vote) could apply and that leaving the language in boilerplate may nonetheless affect recommendation and voter perception. Members asked staff to request either removal of eminent domain wording or clearer explanation in the warrant commentary that acquisitions will be by gift.
The chair said he will follow up with the warrant authors and bring the item back to the committee once the explanation is available.
